Joshua Gregor was stopped by police in Stray Street, Long Gully last September.
His evidentiary breath test returned a reading of 0.211. Probationary drivers have a limit of zero.
His car was impounded for 30 days.
More court news:
In the Bendigo Magistrates' Court on Thursday, defence lawyer Robert Morgan asked magistrate Patrick Southey to consider a fine and the minimum mandatory licence disqualification.
"This is sheer stupidity," Mr Morgan said.
He said his client had not driven since the incident, pleaded guilty at the earliest opportunity, and had no pending charges.
Gregor undertook a road trauma awareness court, Mr Morgan said, and had an appointment for drug and alcohol counselling.
Mr Southey said he took these factors into account.
A similar prior conviction meant Gregor was disqualified from driving and his licence cancelled for 42 months.
He was also convicted and fined $500.
