The 24-year-old man appeared in the Bendigo Magistrates' Court last month where he sought a sentence indication for charges of assault and wilful damage.

The court heard on June 15 this year, the man's partner contacted police to say that the man had allegedly assaulted her and smashed a window at their home.

Police arrived and arrested the man but the alleged victim refused to comply with police.

The man was taken to the Heathcote Police Station for questioning.

Police alleged that while in the station, the man threw two chairs at a wall, causing damage.

The man denied damaging the police station and refused to comment on allegations of family violence.

Defence lawyer Madeleine Mein told the magistrate it was the man's first time in court as he had no prior criminal history.

Ms Mein said the man was still in a relationship with the alleged victim and they have a young child together.

The defence lawyer said while the man conceded there was a verbal argument between the pair on June 15, he still denied causing any damage or assaulting the woman.

Ms Mein said the alleged incident was "out of character" for the man.

Magistrate Alan Spillane said the man had treated the police with a "remarkable amount of scorn".

But the magistrate said the man's lack of prior convictions was "extremely important" and he accepted the alleged incident was uncharacteristic.

Mr Spillane said if the man pleaded guilty to the charges, he would sentence him to a $750 fine with conviction.

Ms Mein said the man would not accept the indication.

The case was adjourned to a contested hearing in December. The man's bail was extended to his next hearing at the Bendigo Magistrates' Court.
