His twin brother Ashley told the court Harley had dyed his hair and was planning to "get away from police" the day after the alleged murder.
The evidence emerged in the second day of a committal hearing as court documents revealed further details of the tragic death.
Joshua Hicks, 23, told the court his younger brother arrived at his Long Gully house sometime between 2am and 2.30am on June 15, 2012.
He said Harley had an X-Box game console under his arm, and was carrying a bag of other items, including a TV set top box.
He said he believed his brother had been out visiting friends.
“I waited up for him watching movies on TV and it was probably 2.30am by the time he was home,” he said.
The Bendigo Magistrates Court heard on Tuesday the X-Box gaming console was stolen from a car near Eaglehawk Road, where Zayden died.
Hicks has been charged with theft, aggravated burglary and murder.
Joshua said on the afternoon of June 15 he moved the X-Box and a baton found in Harley’s room, to a car.
He said he also discovered a wallet in the bag Harley had brought back with him, and asked “where the f*** did that come from?”
Harley’s twin brother Ashley Hicks said he couldn't recall what he, or his brother, had done in the early hours of June 15.
He said he had been in the Bendigo Health emergency department and went home to drink Jim Beam cans and use Xanax after his release.
"My memory's a little vague," he said.
Ashley said one thing he did recall was that Harley dyed his hair black that day.
He said the afternoon of June 15 was the last time he had seen his twin.
“Harley told me he was leaving that day,” he told police in a statement.
“He was leaving with Martina and her child to go to Gisborne. This was to get away from the heat, by this Harley meant get away from the police."
"I told him to go and see dad and give him dad a hug because it always makes me sad when he says he is going away.”
Detective Senior Constable Tom Harper said Harley Hicks was pulled over in a car and arrested on June 19.
He told the court he recalled Hicks had “freshly dyed” hair.
The hearing continues Thursday.
