The 31-year-old pleaded guilty in the Bendigo Magistrates’ Court on Wednesday to multiple charges and was ordered to complete 100 hours of unpaid community work.
Members of the public called police at 1am on July 29 with reports the man was causing a disturbance in Rosalind Park.
Police arrived and reported the man had “bloodshot eyes, his fly was open and he was clearly drunk”, Prosecutor Sergeant Mark Snell said.
The man was “argumentative” towards police and was taken back to Bendigo Police Station.
While at the charge counter, he made an aggressive motion towards a custody officer and said “you want to fight, tough guy?”
The man was wrestled to the ground by multiple officers and re-cuffed, before he was placed in a police cell for the night.
His defence counsel said the man had been celebrating with his wife earlier in the night after doctors had told them of an eligible liver donor.
The court heard the man was still paying off fines for four previous charges of being drunk in a public place.
Magistrate Franz Holzer said it was his last chance before he was sent to jail.
“Next step up will be a jail term, if there is a next time,” he said.
“You have got to watch the grog.”
