Osland loses again

A BENDIGO woman jailed for killing her violent husband has not ruled out continuing her fight for access to documents explaining why she was refused a pardon.

Heather Osland, who spent nine-and-a-half years in jail after being convicted of murdering her violent husband Frank in 1991, submitted a petition for mercy from the Governor of Victoria in 1999.

When the submission was refused, Ms Osland sought access to documents outlining the reasons why.

But the Court of Appeal ruled there was no public interest in releasing the legal advice.

“I am now sure the individual advice recommended setting me free - why else would the Government fight so fiercely to deny me access to the advice?” she said.

“The Court of Appeal’s decision leaves me feeling, in a sense, blind.

“I needed transparency from the Government, but the Government refuses to be transparent and the Court of Appeal refuses to make it accountable.”

Ms Osland said her petition of mercy was written by lay people without criteria or precedents as guidance.

“It was put together for me because many people believed I did not receive the justice I deserved,” she said.

“I had no voice to speak for myself, when everybody around me knew of my husband’s violence towards me and my adult children.

“The petition was submitted to the Government because I’d exhausted all legal avenues.

“I asked the Government to show me mercy on the grounds of compassion.”

Ms Osland will study the decision and plans to consult her legal team for further advice.

Dear Helen, Not wanting to rude but i personaly think its time to wave the white flag, you need to come to a point in your life where you can just let this go. Stop worrying about these documents that you so strongly are fighting for , its quite obvious that the people that have the powers to keep them from you are doing a good job at it. Move on Helen, stop fighting and you will find peace in your life, something that you have control over. My thoughts are with you, and your past life, that drove you to the point where you murderd your husband, you spent time in jail and you are now free, free your mind stop fighting , breath in and find peace within yourself, you cant change the past, but you can change the future. Find a new passion, put your energy to better use, nothing will change what has been, good luck Helen, move on, and enjoy your new life, God Bless.

To 'unknown': It's HEATHER, not Helen. Do your research and then have an opinion. I'm sure Heather has considered her decision to pursue this long and hard and 'free your mind stop fighting , breath in and find peace within yourself' advice from a stanger who doesnt even have the respect to get your name right probably doesnt rate high on Heathers agenda. To 'just a thinker': If you are going to make comments like 'harden the hell up ...your out of jail get on with your life ....yes you were wronged get over it' there's no need to write 'no offence plz' at the end. Own your opinion - if thats what you really think you should either be content to offend - or ready to have a good look at yourself and change when you do offend.
