Joshua Gardner, 34, appeared in the Bendigo Magistrates' Court last week where he pleaded guilty to charges including burglary, trespassing, and intentionally damage property.

Documents obtained by the Bendigo Advertiser said on the evening of January 9 this year, Gardner was observed throwing stones at an old residence near the Malmsbury Train Station.

Gardner then jumped a fence, climbed onto the railway awning, and used a rock to smash a second storey window.

Gardner entered through the broken window before leaving about 30 minutes later.

He got onto a train to Bendigo and was arrested at the Bendigo Train Station.

Gardner was charged but refused to be interviewed. The 34-year-old was eventually released on bail.

The court documents said sometime between 7pm on January 11 and 12.10pm on January 12, Gardner broke into a business on View Street in Bendigo.

He smashed a window but did not take anything from the business.

Investigators found a fingerprint on the broken glass that matched Gardner.

The documents said then on January 16, police located Gardner loitering near the Queen Elizabeth Oval.

An officer asked him to move on from the area but Gardner became aggressive.

He hit one of the officers twice to the face with a closed fist. Gardner was taken to the ground and arrested.

Defence lawyer Julia Breteny said while Gardner had a history of drug and mental health issues, he was now receiving treatment.

She said her client was motivated to continue with his treatment as he did not want to be remanded again.

Magistrate Megan Aumair said there was some hope Gardner's risk of reoffending was reduced due to the new supports in place.

Ms Aumair convicted and sentenced Gardner to 33 days in jail, which was reckoned as already served.

If Gardner did not plead guilty, he would have been jailed for six months.
