THE Save Our Golden Square Pool group doesn't have grounds to appeal to the Victorian Civil and Administrative Tribunal, according to City of Greater Bendigo chief executive Craig Niemann.
Mr Niemann said VCAT didn't normally hear appeals against such decisions.
“It is my understanding Council decisions of this type are not normally able to be appealed at VCAT," he said.
“This type of decision is clearly within Council’s jurisdiction and relates to a Council asset, so I do not believe the Group will have the grounds to lodge an appeal to VCAT.”

THE battle over the Golden Square Pool appears to be heading to the Victorian Civil and Administrative Tribunal.
Save Our Golden Square Pool member Ken Hamilton said the group would appeal last night’s decision by City of Greater Bendigo councillors to close and demolish the pool.
He said he had been “very disappointed” by the decision, which followed a heated debate and vocal protest outside the Bendigo Town Hall.
“It (the appeal) will basically center around council’s reasons to close the pool and the approach the council’s taken,” Mr Hamilton said.
“I think due process hasn’t been adhered to during the whole process.
“We would have loved to have seen genuine consultation, not just turning up to meetings.”
Mr Hamilton said he was confident the VCAT appeal would be successful.
Comment is being sought from the City of Greater Bendigo.
