Odin Gillin, 20, appeared via video link in the Bendigo Magistrates’ Court on Wednesday, where his lawyer, Peter Chadwick QC, indicated his client’s case would rely on self-defence, saying none of the witnesses had seen precisely what happened between the two men on the night in question.
“Nobody sees exactly what happens and nobody sees the weapon,” he said.
Mr Chadwick applied to call a toxicologist to give evidence about what he called a “cocktail” of drugs found in the blood of the deceased man and its likely impact on his “aggression, rationality and suchlike”.
“It goes directly to the circumstances and the behaviour of the deceased and the deceased’s likely state of mind at the time, that my client found himself confronted with,” he said.
Gillin will return to court for a three-day contested committal hearing in August.
