In March, Heath Gray, 33, of Flora Hill, was found sitting beside his car that had smashed into a culvert near the intersection of the Calder Highway and Olympic Parade.
The car was facing south in the middle of a northbound lane. Gray told police at the time he was the passenger in the crash.
He said a friend had been driving, but he did not know the friend’s name, or where he had gone.
He was charged with refusing to nominate a driver of the crash.
The Bendigo Magistrates Court yesterday heard Gray repeatedly failed to answer questions about the driver, only that “he was a mate from Bacchus Marsh”.
A preliminary breath test indicated Gray had a blood alcohol reading of 0.18 – almost four times over the legal limit. Magistrate Frank Jones described his actions as “stupid”.
“All you had to do was make inquiries about his name and pass that information on to police,” he told Gray. “That’s stupid. You’ve now got to deal with the consequences.”
Gray had his driver’s licence cancelled and disqualified for two years.
He was fined $300 with conviction. ?
