Golden Square pool group’s VCAT bid rejected

ATTEMPTS to re-open the Golden Square Pool have had further problems. 

Save Our Golden Square Pool group member Ken Hamilton said the Victorian Civil and Administrative Tribunal could not hear the group’s case against the City of Greater Bendigo, which has twice voted to close the facility. 

But he said the fight was not over and there were further avenues of appeal. 

“The registrar at VCAT said because there’s no actual planning application the council refused, it doesn’t look like they’ll be able to hear our case,” he said. 

“We’re very disappointed.

“But we’ve made some enquiries at the Ombudsman’s office and apparently we have an avenue there.

“Someone said the Ombudsman acts as a mediator and if that’s all they can do we’d be very pleased if they could take on that role.” 

Mr Hamilton said any appeal would centre on an apparent lack of council consultation with residents and an alleged conflict of interest with a company providing the council with information. 

“We’re going to send a letter off to the Ombudsman fairly soon,” he said. 

“We’re also going to talk to a local solicitor about it, sit down and explain the situation and see what kind of response we can get. 

“We’re still very confident. 

“We’ve got a lot of support behind us and good support from the councillors. 

“We’re still pretty confident we can get it overturned and get it open for next summer.”
