Rape accused bailed

A BENDIGO man accused of raping his wife has been granted bail for the second time despite continually breaching conditions prohibiting him from contacting her.The man, who cannot be named for legal reasons, is alleged to have raped his wife, from whom he is separated, in front of their son.He was arrested on Sunday, May 8, after the woman pleaded with her son to call the police.The following Tuesday, the man appeared in the Bendigo Magistrates Court where he was granted bail on the condition he not contact his wife.He was arrested again last weekend after police allegedly found him hiding in the backyard of his wife’s house.He is alleged to have contacted his wife on her mobile phone and left her a note at the house.The man made another application for bail on Tuesday. It was opposed by police.Senior Constable Debbie Graham told the court the woman was fearful her husband would continue to contact her if released on bail, saying the children were also scared.Senior Constable Graham said the man had admitted during a recorded police interview that he had been drinking and had forced himself on his wife. The court was told that the man denied the allegation of rape.The man’s lawyer Kate Youngson said her client was worried about the family’s financial situation if he was to go to jail because he was the sole breadwinner.The court was told that the man and woman were separated but that they were still living under the same roof in separate bedrooms at the time of the alleged attack.Magistrates Richard Wright released the man on bail because the breaches were ‘‘at the lower end of the scale”.
