A KANGAROO Flat man accused of assaulting, stalking and intimidating his former partner has been released on bail.
Jamie Nisbet, 35, was in police custody for breaking the conditions of an intervention order.
He walked free from the Bendigo Magistrates Court despite police concerns he may reoffend.
The court heard claims Nisbet had stalked his ex-girlfriend, with whom he has a four-year-old child, rammed her car with another vehicle and assaulted her on a number of occasions in the past year.
A police spokesman said on one occasion Nisbet straddled the woman on a bed and wouldn’t let her get up.
He said Nisbet breached his current intervention order when he followed her in Eaglehawk on October 29.
The spokesman said when police spoke to Nisbet the next day, he denied the accusations and said he had no recollection of the day.
The court heard Nisbet also admitted to having used $500 worth of heroin the night before and that he had had very little sleep in the past 48 hours.
When asked by prosector Leading Senior Constable Mark Snell if he had any concerns with Nisbet being granted bail, the spokesman said yes.
“Considering the amount of drugs he’s been using and how irrational he’s been acting . . . the safety of the victim is in jeopardy.”
Defence Lawyer Russell Kelly argued that there were no independent witnesses or evidence linking Nisbet to the October 29 incident, and that the woman had a “vested interest” in the case.
He said the couple had been in a long-term on-off relationship and that Nisbet’s ex-partner was a known drug addict who lived with convicted drug users.
Magistrate Richard Wright said although the allegations against Nisbet were serious, there was not enough evidence to deny bail.
He bailed Nisbet to appear in the Bendigo Magistrates Court on December 3.
