$25m Bendigo centre rejected

THE City of Greater Bendigo will advise the Victorian Civil and Administrative Tribunal to reject a proposed $25 million development in Kennington.

The council was unanimous in its decision at is ordinary meeting last night.

The proposal includes the construction of 12,660 square metres of retail space, 1045 sq m of office space, 887 sq m of food and drink premises and 584 car parks.

The council is against the development as it believes it will have a serious detrimental economic effect on existing businesses.

Fifty-four objections from residents and businesses and two letters of support for the proposal were lodged.

Cr Julie Rivendell said one of the major grounds for refusal was that it didn’t meet the commercial strategies of the Bendigo planning scheme.

“It’s also a premature application prior to the structure plan (for the Strath precinct) being completed,’’ she said.

The applicant intends to build in Condon Street, Kennington, after demolishing the Victory College school.

An independent economic assessment revealed the proposal would have devastating results on existing businesses.

“It would result in a real loss in retail goods trade of approximately $10.1 million for Strath Village,’’ city policies and processes co-ordinator Emma Bryant wrote in a report to the council.

“This type of loss would lead to a cannibalisation of Strath Village, where that centre would effectively die,’’ she said.

The applicant, Kennington Village Pty Ltd, has lodged an appeal under section 79 of the Planning and Environment Act 1987 on the basis that the responsible authority failed to determine an application within 60 days.

An administrative mention will be held on December 5.

The full hearing will take place on February 23.

“I would be shocked and horrified if VCAT did anything but adopt our advice,’’ Cr Wayne Gregson said.

What a load of rubbish, of course the Council would be against progress. After all their main concern is trading in the the mall, which is an eye sore with closure of existing businesses, is this because of parking in the area.

I hope VCAT override the Council's decision. Only then will we have competition and progress. I can't wait to be able to shop locally without having to go into the city, bring it on.

Why is the council objecting to this development? If the community wants the centre to be developed then so be it. Haven't the council got something better to do like encouraging development into the community as they say we elected these twits just don't vote for them.

This article is well written, but perhaps it is not quite correct to say that Council will 'advise' VCAT to reject the application. Council is 'requesting' VCAT to take a particular course of action, or 'making a submission' to VCAT. As a legal tribunal, VCAT hears a matter and determines it.

It takes submissions, and then reaches a decision. Councils cannot 'advise' a tribunal, just like the defence or prosecution cannot 'advise' a judge or magistrate in a criminal case.

What is wrong with the council!? This devlelopment would bring new jobs to the area. But no! they're worried about the somewhat little jobs that might be there now. So what they're saying since there is already a small centre there now, NO OTHER centre can go there because of bad business for Strath Village. Ever heard of a bit of competition?
